CONCORD - Today, the Senate Judiciary Committee heard and recommended Amendment #1548s to HB 1375, establishing the elements of a claim for medical monitoring and the damages that may be awarded.
After the committee vote, amendment sponsor Senator Shannon Chandley (D-Amherst) issued the following statement:
“Earlier this month, the Senate passed comprehensive legislation to address PFAS (perfluoroalkyl substances) contamination and drinking water safety. We know the health complications resulting from exposure to contaminated water can be life-long and costly. While we work to prevent further contamination, steps must be taken to assist those who have already been exposed. HB 1375 as amended creates a clear chain of events for an individual exposed to harmful chemicals due to the negligence of a third party to seek compensation without needing to demonstrate illness at the time of the lawsuit. Under Representative McLean’s leadership, members of the House Judiciary subcommittee worked for over a year to craft bipartisan, common sense legislation that passed that full House on a voice vote. I am hopeful that, despite today’s 3-2 vote, my Republican and Democratic Senate colleagues will join the majority of the committee in supporting this bill as amended. In a case like PFAS contamination, where the health effects are long-term and may be slow to develop, this is a crucial step towards remediation in the earlier phases of exposure. ”
