Preliminary Hearing Held for Emergency Motion to Ensure Swift Delivery of Federal Coronavirus Funds

CONCORD— Today, Hillsborough County North Superior Court heard testimony in Mary Jane Wallner et. al. v Christopher Sununu, relative to the plaintiffs’ request to ensure state law is followed to ensure the Joint Legislative Fiscal Committee can fulfill its constitutional role in the disbursement of the CARES Act federal funding as quickly as possible.
After the hearing, Representative Mary Jane Wallner, Senator Lou D’Allesandro, Speaker of the House Steve Shurtleff, and Senate President Donna Soucy released the following statement:
“Today we presented our case to the court in our pursuit to ensure that public dollars are properly and swiftly provided to Granite Staters who need them now. The legislature seeks to fulfill its constitutional role in the disbursement of federal funds during an emergency. The Joint Legislative Fiscal Committee is the rightful authority to have oversight of these critical funds, and provide advice and consent to the executive branch when allocating these funds to support our neighbors who have been impacted by the coronavirus pandemic. We look forward to a swift ruling in this response.”
